Marvin Gaye's Children Have Audio Proof That 'Blurred Lines' Is Infringing on Legend's Song
The ongoing legal battle between Marvin Gaye‘s estate and Robin Thicke appears to be heading to trial. The late singer’s children have filed a summary judgment over ‘Blurred Lines’ and claim to have audio proof that Thicke and producer Pharrell Williams have infringed on their father’s song.
According to the Hollywood Reporter, the children have submitted an audio mash-up, which they believe shows “substantial similarities” between ‘Blurred Lines’ and Gaye’s classic song ‘Got to Give It Up.’
The counterclaim also includes statements allegedly made by Thicke and Williams admitting they were inspired by Gaye’s song.
The summary judgement reads in part:
“Not only was it, therefore, Thicke and Williams who actually ‘smelled money,’ but it was they who then played the role of bully by suing Marvin Gaye’s children when the Gaye children had the temerity to question why their father was not credited, or why ‘Got to Give it Up’ was not licensed, betting that the Gaye children would not have the will or resources to fight this battle. Thicke and Williams bet wrong, and they will now have to face the consequences of their misjudgment and their blatant copyright infringement.”
As for the mash-up audio — quite possibly the first time ever a mash-up is used in a copyright-infridgment case — the recording of ‘Blurred Lines’ plays over the instrumental of ‘Got to Give It Up’ and vice versa.
“This material sounds like a perfect natural match because it blends sonically,” reads the summary judgement.
The Gaye Family — Nona Gaye, Frankie Gaye and Marvin Gaye III — also have testimony from two expert musicologists who say that the songs have similarities in the vocal melodies, hooks, bass melodies, keyboards and percussion.
The summary judgment document also argues why Thicke’s ‘Love After War’ should also be considered as infringement of Gaye’s song ‘After the Dance’
A jury trial has been scheduled for Feb. 10, 2015.

Mary J. Blige Enlists Sam Smith, Emeli Sande for 'The London Sessions' Album
Following the release of her new song, ‘Right Now,’ featuring Sam Smith and Disclosure, Mary J. Blige announces a new project that also showcases some other U.K. talent.
On ‘The London Sessions,’ the singer teams up with British stars including Eg White, Emile Sande, Jimmy Napes, Naughty Boy and SAM ROMANS in addition to Smith and Disclosure.
“It’s all about the London Music scene and I’m so excited to have been part of it, to record my album,” she said in a statement. “The songs are fun, therapeutic and soulful. This is a beautiful change for me and I’m proud of what we have done here.”
Starting her career with Diddy in the early ’90s and now working with some of the breakout artists in soul and electronic music, Mary has been able reinvent herself time and again, which she hopes to continue with this new record. “It’s the reason that people like Mary are so successful — they’re just not afraid to change what they do completely,” Howard Lawrence of Disclosure says in a trailer for the album, which premiered on Pitchfork today.
Although we have to wait until Dec. 2 to hear ‘The London Sessions,’ you can pre-order the album on Sept. 23 and instantly download the LP’s first single, ‘Therapy.’

Sam Smith Enlists A$AP Rocky for 'I'm Not the Only One' Remix
Sam Smith may be a newcomer but he’s already teamed up with some big names — Mary J. Blige and Disclosure just to name a few. Today, he’s added another to his list as A$AP Rocky appears on Smith’s remix of ‘I’m Not the Only One.’
As Smith conveyed in the video for the track, the song looks into a relationship that’s busting at the seams due to infidelity. And Rocky taps into that idea on his verse, which also tosses out references to Beyonce.
“A new disease in my city / Call it idiotic / Pretty lady in my city / Point blank periodic,” he raps at the top of the track. “So Sasha Fierce / A whole lot of tears / Rolling down her cheeks / Crying ’til she’s sound a sleep / Preach, pray that today is not a lonely one.”
This team up just adds to Smith’s long list of other collaborations including ‘Right Now’ with Mary J. Blige and Disclosure, ‘Stay With Me’ with Blige and ‘La La La’ with Naughty Boy.
If you’re feeling this version of the song, you’ll be able to purchase it tomorrow (Sept. 10) on iTunes.

Wale Celebrates the Female Form on 'The Body' Featuring Jeremih
After a long hiatus, Wale returns with a new single, ‘The Body,’ from his upcoming album, ‘The Album About Nothing.’ The song, which features R&B crooner Jeremih, has the DMV rhymer celebrating the female body in all its glory.
Much like his previous chart-topping hit ‘Lotus Flower Bomb,’ Wale spits come-hither rhymes to his object of his affection.
“Girl, you remind me of my Jeep / Can I see what’s up with that G-Wagon / Can I take you off of these streets / To the side of me, I’m tryna see your hazards / Tryna be with the baddest, won’t be the fastest,” he raps.
Meanwhile, Jeremih sings the hook, which is lifted from R. Kelly’s classic slow jam ‘You Remind Me of Something.’
“Baby you got a body like a Benz / And I’m just tryna drive it once again,” he croons.
Along with the song, Wale also released a trailer for ‘The Album About Nothing.’
In the video, the MMG artist gets reflective and introspective about his ups and downs in his music career. We see various footage of him partying, arguing and performing at several stages of his journey. At the end, Wale walks into the recording studio to greet his muse — legendary comedian and ‘Seinfeld’ creator Jerry Seinfeld.

Tinashe vs. Alicia Keys — The Boombox Battle
The Boombox Battle this week proved to be the closest one we’ve seen yet. With 50.37 percent of the votes, Tinashe beat out funk legend Prince, who garnered a close 49.63 percent. This is the songstress’ third consecutive win.
‘In the Meantime’ is Tinashe’s latest track off her upcoming debut, ‘Aquarius,’ set to release on Oct. 7. With a fluid melody, T-Minus’ bouncy beat and the singer’s airy vocals, the song has a smooth sensuality that compliments her flirty lyrics.
“In the meantime, f— in the meantime/ I need ya, but just for tonight, boy,” she sings.
Alicia Keys‘ new track, ‘We Are Here,’ is the week’s challenger. Touching upon the world’s ills and social issues, the piano-driven track puts humanity under the microscope as the singer points to the ways we can be more mindful of the world around us. ‘We Are Here’ is a single off her forthcoming album.
“Let’s talk about Chi-town / Let’s talk about Gaza / Let’s talk about, let’s talk about / Let’s talk about Israel / ‘Cause right now it is real / Let’s talk about / Let’s talk about Nigeria / And it’s mass hysteria,” she delivers on the pre-chorus.
Who will win in this battle? Will Tinashe be able to hold on for another week and enter The Boombox Hall of Fame? Or will Alicia blow her away with her piano-playing, socially conscious tune? Only you can decide. Vote for your favorite artist’s song once per hour until the polls shut down on Tues., Sept. 16, at 10AM ET. Now get to it!
